My two cents, after reviewing some statutes (sorry, dont have my traffic ordinance book with me at home!):

I would say, legally, if you can see the left lane is clear of traffic and you can safely pass the person without exceeding the speed limit, then yes, you are allowed by law to do so. There are no markings visible (solid yellow line) or signs saying no passing. I will ask some buddies their input on it the next time I work.

8-1561. Minimum speed regulation. (a) No person shall drive a motor vehicle at such a slow speed as to impede the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with law.

Now, what is reasonable? Another great legal term like probable cause! Reasonable is how the officer at the time sees it - is the speed the person going, in the officer's opinion, causing the movement to be slower than it should be, and would a reasonable person agree? I stopped someone once for going 11mph on Wyatt Earp and going in such a way that a semitruck could not get aorund him - to me, that was impeding the normal and reasonable movement of traffic.
