The paper said KBI is doing the investigation, so it would be up to them to make an arrest, not the DC cops. I'll bet that if a cop is a suspect that they are doing it totally by the book and KBI probably won't arrest him unless they have a solid case. That's just my guess. As you see, this post mentioned the police had him under surveillance, not the KBI. Thus the reason for my posting what I did. Also you will note the title of my post you quoted.
