Do you really believe that?
I am pretty sure that, whenever you are on the run from the cops for suspected murder, you pose an extremely heightened risk to the community. Look what he did to attempt to elude them. He was in a heightened state of passion and endangerment to the community. Who's to say that if he had the opportunity, he might have taken a hostage at the point of confrontation. He's definitely more likely to do that than someone who is innocent or a mistaken identity. That's a given.
