It isn't a felony. I don't even have kids, but I can tell you that it would upset me very much if somebody that is an adult French kissed a child. The government is sending you to jail for doing that. They increased the crime from a "slap on the wrist offense" and gave the judge/jury the ability to send them to jail if they were found guilty after hearing all the facts in the case.
If it was me on the jury, I would have no problem sending a 62 year old pervert that gets off frenching 10 year olds to jail and them making him register as a sex offender when he got out of prison.
