| Also, if you are being question by the police it's a good idea to ask them if you are being taken into custody or not.
In a ruling I read about this week a woman made statements to the police that were incriminating but she wasn't read her rights. She was never technically "arrested" at that point and was released. Later she was arrested and read her rights.
The cops used her original statements and claimed that since she was not technically in custody she could have refused to answer questions and just left. (I'd like to have seen how that would have worked out for her)
Since she was "free to go" the court allowed her statements.
If they take you into custody, get a lawyer.
If they tell you that you are not under arrest, thank them for their time and leave.
