There is a coverage on their liability insurance that allows them to pay up to whatever limit Sonic chooses, which is normally $5,000 or $10,000. at their own discretion without a lawsuit being filed. Sonic (or any insured) can pay that in order to stop costly lawsuits and keep their name out of the paper. Insurance companies prefer it because it saves the cost of an attorney having to represent the case in court or settle out of court for more than actual damages.
I don't understand why they're finding it hard to sue. Their attorney should be able to bring it to a quick close. Sonic corp would want that, I'd think. The tainted food really shouldn't be necessary, but witnesses would help. Seems if all three people in the car ate the same thing and all were hospitalized, something should inevitably be paid. But never say never in Larned.
