I just thought that was the way the law read...that it was not only illegal to steal property, it was also illegal to have stolen property in your possession.
If the Police came to my house with a search warrant and the proper paperwork to prove that something I had was stolen. Yes, I would give it up, unless I had the proper paperwork to prove that I bought it. Then I feel it would go to a court to decide which paperwork was the proper paperwork and then it would be decided who the proper owner is.
It shouldn't matter that the pawn shop has paperwork that said "Joe Blow" owned it when he received money from the pawn shop. If there is other paperwork that proves beyond a doubt that somebody else did in fact own it, then the paperwork that the pawn shop has, should at that point become null and void. The property should then be returned to the rightful owner, regardless to the fact that the pawn shop has money invested in the item or not. In my opinion anyway, don't know how the actual law would view it. If that is the way it was done maybe the pawn shops would hold a higher standard as to who and what they give money for.
