If the Police came to my house with a search warrant and the proper paperwork to prove that something I had was stolen. Yes, I would give it up, unless I had the proper paperwork to prove that I bought it. Then I feel it would go to a court to decide which paperwork was the proper paperwork and then it would be decided who the proper owner is.
It shouldn't matter that the pawn shop has paperwork that said "Joe Blow" owned it when he received money from the pawn shop. If there is other paperwork that proves beyond a doubt that somebody else did in fact own it, then the paperwork that the pawn shop has, should at that point become null and void. The property should then be returned to the rightful owner, regardless to the fact that the pawn shop has money invested in the item or not. In my opinion anyway, don't know how the actual law would view it. If that is the way it was done maybe the pawn shops would hold a higher standard as to who and what they give money for. |

Ok, tell me WHO gets to decide that?... The judge...ok, who decides what to do about a person having stolen property in thier possession...again...the judge. The police have to have to evidence when they go to court, because the person they are prosecuting AND thier lawyer have to right to SEE that evidence. Therefore that is why...they can NOT give it back to the original owner. See what I'm saying??? I'm NOT saying that is how it should be....It's that it IS the way the legal procedure is.
Do you really think that the pawn shops intentionally take stolen property?? They know the police are going to show up....take it....and they have to answer for it. Do you really think they want the police breathing down thier backs all the time?
Obviously they end up with something stolen occasionally, but ask LE how often that happens. I asked, and was told, not often as MOSt of the thiefs have realized that the pawn shops cooperate with LE. Why do you think that None of the Pawn shops in town will take anything that comes out of a vehicle, even if you have the receipt. It's because of the HIGH theft rate of auto related items.
