I see exactly what you are saying, and I agree. The item should be held for evidence for the upcoming trial. If there is no trial, as in your case, then the property should be returned to the owner.
What I'm saying is that the police didn't take the item in question. Bob's Pawn Shop got to keep it. Bob's Pawn Shop admitted to the rightful owner that he wondered about the guy that sold it to him. He thought he was trouble. But, he still bought the item. In my mind
I say if there is any doubt, then Bob's Pawn Shop shouldn't have bought the item. But, that isn't what happened. He gave pennies on the dollar on an expensive tool knowing that when he sold it he would make a substantial profit on that item. In my mind, that pretty much means he knew the item was stolen when he bought it.
