Ms Hess at it again...

Everyone keeps saying how she lies in court. She is a defense attorney. She is not under oath and she does not testify. Her job as a defense attorney is to paint a picture for the court that casts doubt on the states case and best suits her client. She is supposed to impugn the witnesses, find inconsistencies, and cast doubt upon their testimony. Likewise, that is also what the prosecution does. If she didn't do that, she would be a bad attorney, and she wouldn't be doing her job. The oath that she took as an attorney is to vigorously defend her client. She does it well. You all may want to make this about Hess, but it is not. It is about the jailer. If Hess took the stand and testified under oath, I would expect her to tell the truth as well.

I agree with Tee - Hess isn't doing anything legally wrong when she paints a picture for the jury. We may find it objectionable, but it's not wrong. She's been trained to do that. And she apparently does it well. You're also right, Tee, that the jailer is in the wrong and Hess is right to point it out. I still don't necessarily agree with court, though. Surely, time would be better spent educating him and perhaps being side-lined without pay for a while.

Not only does HESS LIE in court, Tee, she is awfully good at teaching her clients to LIE IN COURT TOO!!! You all can think what you want. I have had too many instances where I caught her in lies. Once a LIAR, always a LIAR!!

As for the jailer, as I already said, hang the bastard!!

Now wait....Has anyone ever thought that maybe Leroy told the jailer he was calling Leslie and called someone else instead, and just lied to the jailer about who he called? I know Leroy, and that is one of the games he would play. Just a thought......

Yeah but the jailer testified 2 times that he (the jailer I'm guessing) talked to Hess. Hess wasn't there......... looks like the jailer didn't recant his story or at the very least didn't say......... I ASSUMED it was Hess...... the female on the phone didn't say she wasn't Hess......... It's just too suspicious and the jailer coulda saved himself this mess had he been talked to by his bosses and told IF your aren't sure...... don't go purjer yourself twice........

Personally I think if the jailer actually perjured himself (which it certainly seems so...... he's not denying that) then he is just as guilty as anyone that coaxes thier clients. I wonder who was coaxing this poor jailer......... doesn't sound like anyone is commint to his aid. I still wonder why - if there is a deputy on duty........... why in the world would they have a jailer do the callin. I see this as a deputy's job. After all jailers are not certified officers and often don't have much more than HS......... they do require HS but lots of times they don't do any more than jailer's school....... it doesn't prepare you for the big leagues when it comes to this kinda stuff.

This poor jailer's job is in the crapper and so is his career...... why?...... cause there was no deputy around?....... cause the jailer took it upon himself to work outside of his scope?........ cause someone told him to lie????? just somethin ain't right here............ not so sure it's all Hess and her sleezy client.

I doubt the jailers job or career are in trouble Tex unless he has a history of disciplinary actions.
Now I do not know how they do it at the jail now but it USED to be the officer brought in the person, did their paperwork, then turned them over to the jailer. That person then did the booking process. Other than the officer giving copies of tickets or wanting to ask further questions, their contact with the inmate was done.
In order to draw blood I do believe the person had to be taken to the hospital since those type of facilities are not at the jail. Since this happened AFTER, then he already gave consent to draw the blood and was already under arrest. He has no right to counsel to answer booking questions. Therefore there was no reason to contact his attourney for him. Like I said in another post, they must be getting soft out at the jail now.
He was probably told to answer the questions honestly, by the CA, before his first court appearance. He also probably thinks what you see on TV is how court is handled and was shell shocked when seeing it up close. I would venture that before this ever went to court he stated somewhere, because he was probably being accused of not allowing the call, that he did allow the call. Why he even spoke to the attorney personally, just to make it sound even better. Now, in court, he testifies to it because he felt he had to stick to it. Not uncommon, and not something to be condoned.

We just don't see jailers go to court - my youngest was a ajailer for over 5 years. He finally got tired of all the BS in a big county jail and is out of the field now. Both my son and DIL started thier careers at the jail. They moved on to street cop but not once has any of them been to court for something so wierd. My youngest worked booking and even had an inmate escape on him but he didn't go to court....... his boss did. His boss was of course a certified officer was the shift sgt at the time. Now my son was the one that bore the responsibility (it didn't end his career) but they don't historically drag lil jailers to court.

Down here you get a phone call after your brought in........ there's a phone you can use in booking. I have even seen them use the phone more than once.......... but no one dials for ya.

I know ya'lls jail is real backwards....... actually was gonna help them open up a medical unit there once. Had a local MD that agreed to be Medical Director and all. Problem was there of course is no policy / proceedure written to cover a med unit at the jail and ya need to go by the state jail standards. Went for interview with a panel and coulda went to work then but didnt' feel $13 an hour was fair pay for my experience as a jail nurse and certainly not enoug for my yrs in nursing to put together a medical program for them........... Typical Ford county.......... wantin something for nothing........ They passed when I came back with a counter offer. I bet that's the closest Ford Co has been to having a Medical unit............ They still amaze me to this day!!.......... but I'm sure they follow guidelines when they know what they are............. OR....... according to this........ maybe not.

I have had a run in with our local police department and I also got to experience our fine jail. I was arrested for Disorderly Conduct for trying to tell a officer what had taken place at a incident and the officer did not want to listen. I was taken to jail and let sit for six hours before being released. While there a JAILER came to the cell to do a search. I am a woman and a woman should have been present. This was 4 hours after I showed up there. I was allowed a phone call but my friend was not until 8 hours later. I filed a complaint with the sheriffs office (jail) and with the police department (police officer) They promised a investigation and guess what nothing happened. I had my day in court and everything against me was thrown out and I was told I should have only gotten a ticket if anything at all. My friends charges were also thrown out because the prosecuting attorney Knew we had been done wrong. I also called the Attorney General, KBI, etc and nothing happened. Our police officers lie to cover their butt all the time, Look how many it takes for a traffic stop. I did my own research on my own time and even found a jailer giving his home phone number to a female when being released, but while there she was ask if she wanted to help with dishes. I am a law abiding citizen who has no record and not so much as a speeding ticket. I do not know Leslie Hess but my hat is off to her. We have attorney's that have to be court appointed and defend all kinds and they only have to raise benefit of doubt. Just because you have a badge does not make you honest, or above the law. I believe this lovely town of ours is very corrupt and we need to clean the inside before we try to make the town look good for everyone else.

Ya know I vaguely remember this on the other board on on the glob board. I do remember this account of what went on. The key words I remember were " I was trying to tell the cop what went on..... he didn't want to listen". Sounds like a lot of interferrin to me. Cops will ask ya if they need to know........ otherwise it's thier call of the law....... not what you feel is the law. I understand your frustration but truth is - a male can search a female so long as it's not a strip search. I'm not sayin all cops are good but trust me one incident maybe even more than one incident doesn't make all cops bad. If you find yourself crossways with the cops ya gotta realize............ it is your actions, lifestyle, past history, or sumthing that gets ya where ya wind up. Just cause they throw something out of court doesn't mean they were in the wrong. Sometimes they don't show up for court cause they feel you have learned your lesson and they got bigger fish to fry. They very rarely forget who ya are tho. When ya see the same behavior from a person more than once ya can't blame them when they come to expect it from you............
