I realize that Jolly Rancher...everything is cool!! I didnt take your post(s) to be questioning cops or saying anything bad about us. Whoever wrote the ticket to your friend was just enforcing the law as it is written. We dont get paid to be the judge and jury, just establish probable cause, which is still a far cry from beyond a shadow of a doubt. I also feel for your friend - I would think if not displaying the placard properly was a habitual problem, sure, impose the fine. If it was an isolated incident, a warning would suffice.

Just to clarify:

I don't want to imply that a law was not broken, but feel the judge should use some compassion, and this should have been dropped. Even if it isn't dropped, the world will not end. Just tired of seeing "evil-doers" let off with a slap on the wrist or nothing at all, when the honest "Joe" takes it where the sun don't shine.

What a response! I really got a lot of good information from this post and a lot of assistance! Thanks to ALL!

Hey, JR - have you been in KC? This happened to me, too - a few years ago when I was freshly divorced and having to count my pennies twice. Except the guy getting the carts from the parking lot noticed and got the license tag. They announced my tag number on the intercom and when I showed up at customer service, they were all too happy to remain on the spot while I called the police. They, too, indicated there would be no ticket issued, which irritated me. The girls were obviously driving irresponsibly - it was late at night and not many cars in the lot. My story turned out better, though - the police were able to track down the car that night and actually woke the mother up to report the accident to her. She called me in tears begging me to take the car to a body shop the next day and not report it - she would pay the body shop herself, as the girl had been involved in 2 previous accidents in which she wasn't paying attention and received tickets. My son's body shop repaired it like new and they did indeed get payment from the mother by credit card (just over $2 Grand) the day it rolled out their door. Luck was on my side, I guess.

I agree. Cuz hit'n run is a ticketable offense, if there are witnesses. Even though this little girl didn't receive any tickets (that I know of). No cop that I know of is gonna spend a lot of time on a parking lot accident if there are no witnesses. Unless the Property Damage is really high or there is Bodily Injury. Anyway - happy Sunday!

Hit and run is ticketable...IF it is off of private property!

Here are the four issues than can be cited for on private property (non-trafficways)....DUI, Reckless driving (which sounds like it would apply in your case, KCM), Flee and elude, and Vehicular manslaughter.

But, we can also get into the debate about traffic ways vs. private parking lots. Here is an example - a traffic way is on private property, but provides an area for the natural flow of traffic; ie, the lanes in front of Walmart directly, the entrance area by Mirastar on 14th, and the entrance area off of Comanche. Where the cars are actually parked, and the lanes between them, is a private parking lot.

Thanks again, NLIRG - it's kinda nice to have you watchin' the board. Not that you pose any threat at all to me way up here in KC, but I might just make it back there one day...and then I'll know to be careful!

It's getting to a point up here that I hate to drive at all unless it's back and forth to work - and then ony on the freeway.

Justice

Let's just hope this person has the ticket dropped. It is a joke if the judge saw he was handicap and did not drop it. That's not what I would call standing up and doing his job, It's called stupidity for seeing that he was disabled and not tossing it out..........

The Judge has a brother (JOHN DOLL) who wants to be a State Representative.

One would hope that putting a blind eye to logic isn't a family trait. If it is, then he'll make a fine Legislator.
