From what I have seen here, doesn't look like Officers even know the answer to the question or differ on the answer.

...and yet they will call you an idot for not knowing when they pull you over in an unposted area.

They like ambiguous speed limits.....means more traffic tickets for them

OK - I did my research - I might be wrong!

I asked my DIL who is the most rule stickin girl I know. Other officers from other agencies call her when they aren't sure on a rule - specially narcotics but many narc stops begin with a traffic stop so I consider her pretty smart there.

She says down here - If it is a comercially zoned area, and there is a broken yellow line - passin is permitted.............. there is no passing over any line in a residentially zoned area.. period........... she also said that's a real gray area and she could always find a better reason for stoppin someone. The turn signal 25feet from the intersection is a good one to get someone on...... they always turn thier blinker on at the intersection...... so if ya wanna be picky that's an easy one to get nailed on.


So see - I was wrong (I guess) I don't know the zoning on 6th but I know there is a funeral home there so maybe it's commercial....... I just always thought of 6th as residential............ She is familiar with 6th as well but didn't remember any yellow lines....... she says tho that usually residential areas don't have lines so she was figgerin it must be comercially zoned......

Ya can come drive in Texas now and not get in trouble........... LOL

Hope this helps

Here is a link to the Standard Traffic Ordinance book that we all go off of when issuing citations. I do know that 6th is 30 mph and is not commercially zoned for speed. If you look in section 40, 42, and I believe 46, it might help answer your questions. I think the problem you will run into in passing on 6th is all the intersections. I remember when I first moved to Dodge, I tried to pass a slow moving vehicle on 6th at about Oak north bound. I passed and was met by an oncoming vehicle that had just turned south on 6th from Hickory. I had to pull to the right side of the road to get out of the way. Hope this helps everyone. Not sure why the officer was doing 11mph for that long, but I'm sure he had a good reason, we've been busy with a lot of crap.

that this section shall not apply to any intersection
on a state or county maintained highway located
outside city limits unless such intersection is
marked by an official department of transportation
or county road department traffic control device or
pavement marking or both indicating that passing
is prohibited and such marking is placed at least
100 feet before the intersection; or
(3) When the view is obstructed upon approaching
within 100 feet of any bridge, viaduct or tunnel.
As I mentioned, to pass on 6th south of Comanche would cause you, unless the car you are passing is sitting still and in the middle of a block, to be within 100 feet of an intersection, in my opinion.

I think I was right - you are allowed to pass in that area, so long as you can do so without coming within 100 feet of an intersection and do not break the speed limit. Now, is that possible? I dunno...maybe I will try it some night at 3am with another officer and see if it can be done! I am betting no...but seeing that a block is longer than 100 feet, there is some room that the pass could be done.
