I've been thinking about this today:

(c) Law enforcement officers shall issue a warning citation
to anyone violating subsection (a)(3). (K.S.A. 8-1703,
as amended)

And how the word "shall" applies toward who's making the money.... err; rules.

On the Wright alcohol plant thread, the rules said that a plan "shall" be submitted but the County Counselor decided that "shall" meant "may"...

I was wondering what a "warning citation" was. Is that a warning or a citation?

It's a warning.

Citation just defines the act of writing and issueing it.

Monday after work 5pm. I was on my way home some of it is highway and some in town. But I counted 6 cars with out any lights on and one with just parking lights (RUNNING LIGHTS) on. You all know what it was like Mon. at 5pm outside. Needed to have lights on.

In my professional opinion both tickets would be summarily (sp) dismissed in district court. For two reasons 1. 8-1703 (a) (3) can only be issued a warning (either verbal or written ) and 8-2503 requires that a citation be issued for the primary violation. Example you cant stop a person for having a defective turn signal and then issue a warning for the turn signal and a citation for the seatbelt. You MUST issue a ticket for the primary violation. Having said that, city ordinances do sometimes vary from state statutes, but in general do coincide with them. Not being a city officer, I dont generally read their standard traffic ordinances book.

The way I understand it is I get to ask the officer questions. I guess my first would be to ask her, under oath, if the reason I was stopped was because my lights were off. Then I would produce my signed statement from the GM dealer stating that on my 2005 Pontiac there is no switch to turn the lights off. There is only a Auto, Parking and ON. Per the manual, which I plan to take, the lights are on all the time. Auto simply turns them off, after 60 seconds, when the car is off.

Basically saying if my car was on my lights were on. So I was stopped under false reasons so I could be ticketed for my seatbelt.

I wonder if you could request a meeting with the city attorney or his assistant prior to court and get them to dismiss the ticket.

Not only that, but when you put a GM car in drive the headlights come on. My 1998 vehicle, i can turn the headlights off, but day or night, when the shifter goes to D, the low beam headlights come on. There will be no taillights, but the headlights are on.
