I don't get this - he has no insurance? That's not a ticket right there? If he has dealer tags on various cars - does he sell cars? If that's the case I would be talkin with the company that supplies the tags. Is the street private property? Isn't that where you got hit? If he backed into you - I don't think the street is private property. This just don't make sense to me.

He told me he didn't have insurance. The plates that he had on at the time of the accident were dealership plates which were owned by a small dealership here in town. He works there and was supposed to be trading off his car for this blazer (the one that hit me) but no papers were drawn up or finalized at that time. I'm not sure what he does at the dealership I was just informed that he works there. My insurance is going to find out about the tags etc. If the tags are faulty I was told to contact a guy in Topeka which I will be when I find out.
The street isn't private property, but his driveway is. That's where his vehicles are. My street is N and S, I was facing North getting ready to put it in drive when he backed out of his driveway (which is directly across the street from my driveway) and he hit me.

The dealership is on the hook for your damage unless the tag was not on the vehicle with their permission. If a person would take a dealer vehicle for a test drive and get into an accident, the dealership is on the hook if the driver's insurance doesn't cover the damage.

There are rules that go with dealer plates, such as, Salesmen can use one on a dealer supplied vehicle for his own personal use. The wife can also (but I forget if it's the spouse of the salesperson, or the wife of the owner, can use a dealer tag for personal use of a dealer supplied vehicle. But, friends, and neighbors, and their kids can not use a dealer tag. I *think* the Kansas Department of Revenue would be the agency to make an inquiry or complaint.

Also as a correction to an earlier post, you would need to call the State Insurance Commissioner rather than the KS AG.

Accident

Hey Tat, Did not see this covered, but it sounds like this "gentleman" may work for a car sales company being that so many tags have been used on that car!!!

If that is true, then whoever it may be, is trying to snow you about the Ins. coverage. The company he works and gets the car to drive from, had the Ins. on this car, and they HAVE TO HAVE IT! Sounds as if no one is letting you know this, if this is the case. I will pray for you, if you will pray for me!!!?

Ok, I will pray for you no matter what!!!! lolol Just a little orneriness!!!

Perhaps they are bonded. Do yall have that? I know UTMB doesn't carry insurance on thier vehichles - they carry bonds. Does Ks have that too? It' an option (Ithink) in Tx but someone is bound to be responsible. So wat's the update TaT?

If the guy has dealer plates on the car that hit you, there's insurance somewhere. If the driver's not carrying it, the dealership is. I don't think Kansas requires bonds of car dealerships unless it's a bond to guarantee taxes. They are required to carry insurance, though. This one sounds like a small dealership, so who knows if there's appropriate coverage? I'd definitely be finding out.

Yeah he works for a dealership where the plate came from. The owner of dealership claims this guy was trading his vehicle for this blazer that hit me, but no papers had been drawn up yet. In the last week I've seen 2 different cars there both w/ 30 days tags, and a truck appeared yesterday w/ dealership plates!!! I'm getting so mad and frustrated that he's getting away with this while my car is still dented up!!! As for the bond situation I'm not sure what that is, I've never heard of it... I turned a claim into my insurance and they will be going after the other insurance company.. I'm going to call my adjustor tomorrow and find out the progress.

Can your insurance guy ‘lean’ on the dealer, or has that already been tried?

Not sure what I can do as for the dealership, she said she was advised to file theft charges against the driver, not sure how that can be done considering no papers had been filed yet for the tradeoff.

WHAT??? That's insane! Unless he was supposed to have the car back and didn't. This just sounds all wrong. Somethin is missin.

On another note - did they ticket this guy? Is the police report on the accident or the expired / non esistant tags on vehicles? Ya need to stay focused on the issue - your car is damaged cause of him suposedly. Harrasin him over shit on his property or anything else won't help your car get fixed. Besides............ it's evil in itself to seek revenge rather than just plain justice.
