Intact bullet was not recovered it was in two pieces. But does a bullet of that is shot from that calliber of a weapon normally go through something especially if it was shot at close range? As in exit wound? (just curious)

As far as papers go.......all i'm saying is whatever he received whether it be papers saying he was being investigated or what they said 2nd degree murder on them.

I don't know why he ran and no one would have said he was running if he hadn't made the stupid move to steal a vehicle. He was free to leave town and to leave the state as he pleased. To my knowledge noone was looking for him until the Colorado police department called and said we have someone here that says they are a possible murder suspect.

Believe me I'm as confused as you guys are on this thing i'm just not as quick to judge as some are

Circumstantial evidence, yes.
So?

They couldn't, and DIDN'T have to.

No bolt, no ballisitics.
They couldn't prove that a .270 was used, so they did the next best thing.
Load taped confession, push play.

During the interrogation?
So, all that proves is Tahah isn't very bright.

Or, maybe he confessed b/c he was in fact the one who pulled the trigger.

Why does it feel like we're all just reposting the same facts...

It would depend on if it was a soft point or full metal jacket and if it hit a bone or just soft tissue.

A replacement bolt could be fitted the test the rifling but I don’t know if rules of evidence allow for that.

If the bullet shattered on impact there would be no point.

I think there would be some point to it. Eventhough, you couldn't go by the markings on the casing because we know that the casing definately came from that gun, but I think i might prove the shape of the bullet. (maybe, I'm no detective) The bullet wasn't described as shattered but as fragmented into two pieces. Does this mean that there would still be no point?

I’d like to hear from one of the folks familiar with rules of evidence if having a gunsmith fit a replacement bolt would be considered tampering with evidence or not. Perhaps it’s not allowed.

Either way I don’t think it will constitute negligence on the part of the investigators and the lack of ballistics probably will hold up under appeal.

Thanks Highwayman, for not being judgmental. you've spoke your opinion but have not been hateful about it. I respect that.

I have no clue as to what would hold up in court and what wouldn't.

I'm trying to figure this thing out myself.

Thanks again!

Evidently everything they presented in court held up pretty well. Either that or this was the defence attorney's first rodeo.
