Also, if you are being question by the police it's a good idea to ask them if you are being taken into custody or not.

In a ruling I read about this week a woman made statements to the police that were incriminating but she wasn't read her rights. She was never technically "arrested" at that point and was released. Later she was arrested and read her rights.

The cops used her original statements and claimed that since she was not technically in custody she could have refused to answer questions and just left. (I'd like to have seen how that would have worked out for her)

Since she was "free to go" the court allowed her statements.

If they take you into custody, get a lawyer.

If they tell you that you are not under arrest, thank them for their time and leave.

Well I spent 4 days in jail and never had to get a lawyer because the girl who said that I threatened her, went to the DA and told him that she lied to get me in trouble and that others asked her to lie for them to get me trouble. It was overall a bad deal for me. They did not have any evidence I did this; just a bunch of people who hung out in the same bar saying I did this too so they could get me in trouble and get more free drinks and beer. It was **** with Pootsie year that year. Not a good time for me at all.

I'm pretty sure that was the same night I saw you punch that girl. I was called as a witness and so was the girl with me and we both saw you punch her with her back to you at the DO.

She didn't show up because she knew you weren't going anywhere but right back at her after it was all over.

I don't know what you THINK she did or said after but you definately punched her because you thought she was after the same guy you were.

First off Wordy this is not the incident at all. If I do something I damn well admit it. Second off I do not remember ever getting into a fight at DO's,maybe a argument,but never a fight. And another thing, I do not punch people from behind. You obviously got me mistaken for someone else. Don't talk shit like that on me. Now if I punch someone I usually had a damn good reason...if she was after the same guy I was, she was mighty brave. I did not take too kind to BS like that. One thing about me I took care of my own issues my way. It was not the right way back then but I had to put up with alot of BS being raised by 5 brothers and about 50 boy cousins. I got my ass beat daily hahaha. It never failed, people screw with me, I beat their ass, they call the police.

One day I got smart, quit fighting, and started calling the body guards I pay tax money for; the DCPD. Nobody liked that. It was allright for them to call them on me, but when the tables were turned, they were pissed. People quit with messing with me.
