| 41-715. Sale of liquor to incapacitated or intoxicated person; penalties. (a) No person shall knowingly sell, give away, dispose of, exchange or deliver, or permit the sale, gift or procuring of any alcoholic liquor to or for any person who is an incapacitated person, or any person who is physically or mentally incapacitated by the consumption of such liquor. (b) Violation of this section is a misdemeanor punishable by a fine of not less than $100 and not exceeding $250 or imprisonment not exceeding 30 days, or both. History: L. 1949, ch. 242, § 78; L. 1963, ch. 267, § 1; L. 1965, ch. 277, § 8; L. 1985, ch. 173, § 1; July 1. This is a statute rarely used I am sure but it does put liability on the server. In my vision this is the SMASHED customer. The establishment should ensure 1. They are not driving. 2. The customer is not in a state to be a danger to themselves or others i.e. So drunk the will stumble into traffic trying to walk home. Simple don't serve ANYONE to a point of incapacitation. That is for drinking at home when it is on nobody but yourself. I am sure we can list the establishments in Dodge City who abide by this and watch out for all of their customers and not just the ones they know. Most just don't want someone too drunk because they are unpredictable and tend to start fights or damage property. |

| Dui Sorry you got a DUI, but as many have already said, don't drive if you are drinking alcohol! So many do, and so many terrible things happen because of it. I have seen these things first hand, due to the fact that I was a E.M.I.C.T. and was the Director of an ambulance service here is S.W. Kansas. I have seen what others can't even imagine, because someone decided that they could operate a vehicle in a drunken state! One of the calls I remember is when we were called to a home, and that a 12 year old female had been hit by a car. After arriving at the scene, we found out what had happened and just had a very hard time believing our own eyes! This 12 year old girl was playing with some friends on her own front porch when a young man who was drunk, lost control of his vehicle. He was going at a very high rate of speed in a neighbor hood of homes and children when he lost control. He swerved and came up over the curb, slammed his car into the porch and the wall leading into the living room! The girl was standing there and froze when she saw this car heading straight toward her. He hit her head on, went through the wall while she was pinned to the front of the car and ended up in the living room of her house. The P.D. estimated his speed was between 60 and 70 m.p.h when he hit her. Her leg was torn from her at mid thigh, and her hips were crushed. She also had internal abdominal bleeding. This girl was conscious through the whole ordeal. While treating this girl and getting her ready for transport, the P.D. made this young man stand there and watch what was happening. His comments were a mess of racial slurs and many more slurred words that made no sense. The young female was of Hispanic origins. We completed field treatment with I.V.s going full bore trying to increase her volume of blood that had been lost. We packaged her severed limb and transported her. Her leg could not be reattached because most of the bones were crushed. My point here, is be thankful that you were stopped before something like this could have happened. On most if not all of the calls we received that involved a drunk driver it seemed that the drunk had little injuries while the innocent came away with extreme injuries of death. So, you may have just been saved from a lifetime of guilt for what may have happened if you had not been stopped! Something to give some thought too! |

| I'm not. Me and my family would like to thank the DCPD for attempting to keep the streets a little bit safer for my daughter and us. NOW if we could just crack down on a few up the unlicensed drivers.....lol By the way. What is the capacity of our city and county jail?

| I have to agree with all the posts against DUI & Drunk drivers...I am one of many in the EMS field that has responded and treated both the "victim's--people who are DUI and the unlucky ones that have been the "true victim" of drunk drivers or ppl that are under the influence of an illegal substance.* It's not a pretty site to see a person or persons, who have severe trauma and the chances of survival is nil.* It's unnerving to hear the love ones scream and cry loudly while you are trying to help the injured.* And then hear the KHP, SO or any law enforcement tell the family, sorry they didn't make it or when a member of the family comes up to you and ask, "Are they going to ok when you know that they're not.* You try to comfort them with words that you know may not be true because you want them to have some hope.I was on the receiving end a few years back on the day after Christmas, when I had both the KHP and SO, who came to my home to tell me that my brother was killed by DUI.** So stuff shit, when you say that the real victims are the ones that come out of a bar after a night of drinking and are being "picked on" by the LE.* I just hope that I don't have to pick up your sorry ass some night, after you've been drinking and caused an accident. My daughter is the president of her SADD chapter at her school and she definitely one that takes her leadership to heart and keeps students informed about it's OK to say NO to drinking & driving and how to deal with peer pressure and provide the students with tools to deal with these issues. It needs to start somewhere, if not at home then in the schools. People who decide that they want to go out and party then get behind the wheel and drive, get pulled over and fail the soberity test,**SS, I won't be one to feel sorry for your ass when you spend time in jail.* Maybe just maybe, that will bring some common sense to you and you get a DD. Give your keys to someone that hadn't anything to drink.* You and others will be a lot safer. And that's all I have to say about that!!

| As a former LEO I have arrested several drunks in my life. I have also worked accidents that here caused by drunks. The one that sticks in my mind right now was a groom that went through the front windshield of a vehilce after the vehicle hit a tree the night before the wedding. His best man was driving. Now there is a best man for you. The groom survived but the wedding had to be cancelled because the groom was life watched to KC for surgury. I took the driver to jail and for DUI. Was three times the legal limit but thought he was OK to drive. I also lost my best friend in high school after the car that he was driving at over 100 mph rolled several times. So I could care less if the cops sit outside of bars. Again I get sick and tied of people bitching when they get caught breaking the law. Don't break the law and you won't have any trouble. But, if you hate the cops so much don't call them the next time you are in trouble.

| Hey look, I am against Driving under the influence and in the past I did it many times and then some. I have now changed my life' however, I do not agree with the cops sitting outside a bar waiting for people to leave. In the past I know police that shut down businesses because of that same thing. People won't go, even the ones that do not drink and drive, they don't like getting pulled over! Ok, next time Ask Vinnie plays in town why don't all citezens in DC get together and watch all the people that get in their cars and drive away...lets do it, and see how the cops like being watched.
