Whats happened to democracy?

Source: http://www.foxnews.com/story/0,2933,194240,00.html

I saw on the news this morning that a Judge in San Diego has ruled a cross on a memorial as unconstitutional and must be taken down. The city has voted on it several times and 80% of the voters want it to stay yet this judge has the power to ignore it? How the hell does this happen in a democratic society?

Main Entry: de·moc·ra·cy
Pronunciation: di-'mä-kr&-sE
Function: noun
Inflected Form: plural -cies
1 a : government by the people; especially : rule of the majority

I'm surprised the Korean War Vets aren't all over this........ there are still plenty of them around............. even if the guy wanting it down is a vet....... he doesn't represent the overall beliefs of any VFW, or most Vet organizations......... why should the city fight this battle for everyone? Hell there are bound to be plenty of vets that are from that era that are retired attorneys - why wouldn't they do this pro bono????......... oh yeah we ARE talking attorneys!!.................. that's just sad. Not from the religeous aspect but from the historical aspect......... it's just sad.

Yeah especially the minority with it's head up its ass............... this is just stupid stuff.............. if ya don't like what the men / women that actually fought wanted up as a memorial......to THIER contribution to the country...... then don't go visit the site.

This has nuthin to do with memorials and such ............. it has to do with a guy that wants to make a name for himself on tax payors money. Even if he is a vet......... bet it's not the Korean war he's a vet of............... his head is in his ass.

The Constitution protects the rights of everybody including the Christian majority. The atheists do not have a right to not be offended.

As I was reading this it seems like a simple solution would be to transfer the property to the Mt. Soledad Memorial Association. That was tried and blocked by the courts. That says to me this isn’t about having a cross on city property, it’s about tearing down a cross because some atheists are offended.

The memorial is just that. It memorializes those that died in the Korean War. Unless Philip Paulson had an ancestor that died in the war that this memorial represents, then he has no right to oppose the memorial. I say the only voices that matter here are the families of ones that the memorial represents. It would be no different if I resurrected a memorial over my mothers grave with a cross on it. The guy is an atheist activist looking for his 15 minutes of fame that needs to be shut down. Offended or not, he has no voice in this matter.

Speaking of voices, removing the cross would be a violation of the free speech and freedom of expression rights of the folks that put it up.
