As noted in an October 26, 1994, advisory memorandum from Roy Caldwell Kime, International Association of Chiefs of Police (IACP) Legislative Counsel to IACPNet Subscribers which was distributed November 2, 1994, the above section makes it a federal crime for any person, including law enforcement officers, to possess firearms if they are under a court issued adult/spouse abuse order issued after notice and opportunity to appear.

The proviso might be whether (or not) 'abuse' is an issue.

Well if he was on suspension, wouldn't he not be permitted to carry a firearm while on suspension? Can they upgrade it to first degree?

Just because people are saying it doesn't make it true. Don't believe everything you hear (or read). I have heard some wild rumors, too, and just like this board, there are lots of people saying things that have no basis in fact. When I read it in the paper, I MIGHT believe. Or I might not. But I would give more credence to an offical quote by the KBI in the paper than gossip on the street.
