They have not been given special treatment, they have been treated as a clinic or physician office offering limited "minimally invasive" procedures. Under the same rules that allow some physicians perform limited endoscopy in their office. In many states with the exception of the laboratory portion which falls under a federal regulation, physician offices do things like EKG's, stress test, minor surgeries, etc with minimal oversight. Every state is a little different and sometimes there are different levels of oversight depending upon the size of the practice.
What MO has done is bring the abortion stores up to the standards of a surgery center which is typically regulated one step below an acute care hospital. It was not done to ensure quality standards apply to abortion clinics, it was done to raise the "hassle factor" and costs of operating an abortion shop in the hopes that some practioners would say "it's not worth it".
