| I can't imagine Scott's actually being able to pull this off - My guess is a VERY small % of thier employess actually are smokers so the risk of class action discrimination law suit is low. I think they could ofset theri high rates if they charge smokers more for their health care but only because that is actually something that has been done for awhile. Firing I don't think is truely legal no matter what they say. Don't worry all the fatties are next......it's commin cause us smokers have been beat to a pulp - there isn't much more they can do to us.......just wait........LOL

| Yeah - this is gonna be interesting to watch - if it gets that far. Expect your lawn care products to go up so they can pay all the settlements. What a pile of manuer......honestly - I see this will be a "don't tell" kinda thing. Hell you can get lung dz and cancer from anywhere - it ain't all about smokin...........wonder if that smokin policy covers all the They sure are gonna be busy with the discrimination stuff.....I don't care about "at work" they can do what they want - but "on private time" and "in your own home" is none of their business UNLESS you are doing something illegal and it is a direct reflection to the company you work for......good Lord what a world.....

| I was thinking, really I was, they can't hardly go after the overweight people. Correct me if I'm wrong but isn't obesity now considered a handicap and therefore protected by the ADA?

| Only MORBID obesity can be a handicap - you would almost have to be in a wheelchair cause you are too fat to walk..........to fit into the BMI index you aren't talkin gastric banding. They pay for that as well and obestiy causes more issues becasue it is not only a physical issue but a mental one as well......this stuff is just so dumb...Ya can't fire and hire people (in the open) based on discrimination issues that are Legal......being fat is legal too so everyone will be protected when they get around to the fatties. PS a healthy life style is based on overall health - this does include your BMI
