Police Say HIV-Positive Woman Raped Boy
December 22, 2005

AVOCA, Ark. -- Authorities said a 13-year-old Arkansas boy was exposed to HIV when he was allegedly raped by a 42-year-old woman in his own home.

Deputies thought they were headed to a domestic disturbance call at the teen's home near Avoca, Ark., at about 2 a.m. Monday.

When they arrived they found two men arguing with a woman named Donna Sue Mars. However, during subsequent interviews, police said one of the men said Mars had sex with his 13-year-old son, Fort Smith, Ark., television station KHBS reported.

Officers confirmed that the boy said Mars forced him to have oral sex.

They later discovered she is infected with HIV, and it's a crime for somebody infected with the virus to expose someone else knowingly.

Mars' relationship to the boy is unknown. However, police said the age difference between her and the alleged victim is enough to charge her with rape.

"The woman was indicating that the juvenile was a consenting member, and the juvenile was indicating he was not -- that she somewhat forced herself on him," said Benton County deputy Doug Gay.

Police said the woman was charged with rape and with exposing another person to HIV, which is also a felony. If convicted, she could face a life sentence. Mars is out of jail on $25,000 bond.

The way I see it, she is wielding a deadly weapon and isn't afraid to use it. They should lock her up and throw away the key. And give her no medical treatment in the meantime.

Miss Muffin - why isn't this crime equal to premeditated attempted murder - or even murder. The woman knows that sex with her could kill the other party. In this case, there's the addtional crime of child abuse. All of these seem to support a deeper felony charge that IMO could support a death penalty. I don't know how it could be worse for the victim, regardless of the sex of either party, to be molested or raped by a perp who knows they are HIV positive. I don't think I would hesitate long in giving them the harshest sentence my State would allow.

My point exactly. Except I wasn't sure Arkansas was a death-penalty state. If it is, I'm with you - slip her the needle. But let's not let her waste our time and money on appeals and jail time. And I repeat - no medical care.....

I think if your HIV it's "aggrivated rape" IF you are Aids + , then I think it's a felony.....not sure but I kinda remember sumthin to that affect. Maybe some smarter folks could tell us..........She certainly has a deadly weapon.

What is it with ARK?????

I believe rape in itself is a felony, no matter what state it is - it is one of the most destructive crime one human can commit against another.

According to Arkansas laws, their "statutory" rape law says sex with anyone where one party is over 20 and one is under 16. It is a class Y felony.

After reading thru their laws at http://www.aardvarc.org/stalking/states/arkst.shtml , they use the term "deviate sexual activity" quite often, which pretty much includes everything from oral sex to just about everything besides actual intercourse.


However, after reading further, I just found this...
"...has tested positive for human immunodeficiency virus and exposes another person to such viral infection...engages in sexual penetration with another person without first having informed the other person of the presence of human immunodeficiency virus.
(c) As used in this section, "sexual penetration" means sexual intercourse, cunnilingus, fellatio, anal intercourse, or any other intrusion, however slight, of any part of a person's body or of any object into the genital or anal openings of another person's body, but emission of semen is not required. "

Anyone who violates this in Arkansas is charged with a Class A felony.

Thanks - on point research that helps. Rape is truly one of the most violent and invasive acts that can ever be done to another. When it comes to HIV, though it even gets worse, as the perpetrator knows that the act could be fatal. That should be attempted murder every time and/or if the rape victim dies, the charge is raised to murder. That's the level I would like to see, regardless of the sex of the participants.
