I don't believe the article stated that the job required them to be non-smokers/tobacco users. It just stated that they said they were non-smokers/tobacco users on their initial paperwork, then were later found to be smoking or chewing on company property. Again, they could have been telling the truth at the time they filled out the paperwork, then took up smoking or chewing at a later date. If there was nothing on the paper telling them they had to report any change of status I don't see how it is relevant.

Judging from the facts in the article and not the ones you pulled out of your... imagination, they lied and they are getting canned based on that.

Insurance paperwork is different from requirements for working. If the insurance premiums for the entire company were raised because of this then that is different. If the premiums for those workers is raised, then it is up to them to pay it out of pocket. Like I said, I had to be tested for tobacco on the last three jobs I had even though I admitted to being a smoker.
Obviously this company allows smoking/tobacco use since they were caught in the smoking areas of the workplace.

Of course not. If the company wants to lay them off because it's Tuesday and the manager hasn't been laid in a month.....so be it. That is their right as far as I am concerned. Do I think it is right, no, but that is just my opinion.

If the employees lied on their resume, application for employment, or whatever that involves their employment that is one thing. If they lied on an insurance application that only effects them, then I think the company is going a bit far is all.

The employee commited fraud to get a lower rate than they are offered.

The company gets better rates because they take on the responsibility of asking who smokes and who doesn't. If they dont' do that then the insurance company raises everyone's rates.

Fraud is illegal.

But unless you know for a fact that they lied, I.E. did not smoke prior to saying they didn't, then you do not have fraud you have assumption, which is not illegal.
I would guess they did lie...........pretty sure they did...........but I do not have a dog in this fight because i truly do not care. Just posted my opinion is all.
