| I'm surprised that they admitted that they didn't go out. By law, W-2's are supposed to be postmarked by Jan. 31st. You are also supposed to allow 2 weeks for the mail to get them to you. Most companies will lie to you and say they went out, then they have until Feb. 14th to get a "re-issued" one out to you. If you still don't have your W-2 by Feb. 14th, you may be able to file using Form 4852 which is a substitute W-2. Here are some links to the IRS website that may prove helpful for you. Here is a link for Form 4852... http://www.irs.gov/pub/irs-pdf/f4852.pdf But if you estimate wrong on the 4852 and after receiving your W-2 find that some numbers are different, then you will have to file an amended return. | You order the forms and how many you need. One would think you would look at them before January 31 and have them corrected instead of waiting until the last minute to realize you didn't have the right forms....Poor planning on your part does not constitute an emergency on mine. |

| I always heard they HAD to have them to you by the 31st.... but according to the IRS "Your employers are required to provide you with Form W-2, Wage and Tax Statement. Form W-2 must be mailed out or hand-delivered to you no later than January 31st." I say..."Turn them in if they aren't postmarked prior to the 31st!!" (unless they are willing to pay you interest on your refund, they shouldn't be able to break the law) On another note....The IRS is not accepting e-files for Kansas until after Feb 3rd, due to some computer software changes they are making to accomodate a sales tax exemption for Kansas. I am ready to file mine but it wont let me.

| The software issue is not unique to Kansas. There were several changes in the presentation and treatment of things that were proposed and made effective before the IRS had time to change the affected forms. The Sales tax is the big issue but there were other areas that had to corrected in their programing so e-filed returns could pass the edits and be accepted. Personally I will be surprised if they are ready on Saturday.

| Not picking on this post particularly but if one is due a refund for overpaying their taxes, one needs to seriously consider decreasing the taxes withheld during the year. Uncle Sam thanks you for the interest free loan.
